No more abuse of double taxation treaties
Former shareholders of gas utility SPP, Gaz de France and RWE, broke the law when they paid dividends to the Netherlands two decades ago and did not pay dividend tax in Slovakia, the Constitutional Court ruled. Its landmark verdict is likely to affect other cases of shell company abuses in countries with favorable double tax treaties. Previously, the Supreme Administrative Court also ruled in the state’s favor.
